On December 7, 2018, the North Carolina Supreme Court issued its opinion in Dr. Robert Corwin as Trustee for the Beatrice Corwin Living Irrevocable Trust v. British American Tobacco PLC, et al., No. 56PA17. In its opinion, the North Carolina Supreme Court concluded that the plaintiffs had failed to sufficiently allege that British American Tobacco PLC had breached any fiduciary duty to the other Reynolds shareholders. In doing so, the North Carolina Supreme Court reversed the Court of Appeals’ contrary opinion.
