On December 7, 2018, the North Carolina Supreme Court issued its opinion in Dr. Robert Corwin as Trustee for the Beatrice Corwin Living Irrevocable Trust v. British American Tobacco PLC, et al., No. 56PA17. In its opinion, the North Carolina Supreme Court concluded that the plaintiffs had failed to sufficiently allege that British American Tobacco PLC had breached any fiduciary duty to the other Reynolds shareholders. In doing so, the North Carolina Supreme Court reversed the Court of Appeals’ contrary opinion.
H. Brent Helms of Robinson & Lawing, LLP is pleased to have served as counsel for the defendant-petitioner, British American Tobacco PLC, along with Gary Bornstein of Cravath, Swaine & Moore LLP.
